labreporter.in is a Laboratory Information Management System developed, owned, and distributed by KRISHNA SOFTWARES, Surat, Gujarat, India. All intellectual property rights in the software and related materials remain vested with KRISHNA SOFTWARES.
1. Acceptance of Terms
By purchasing, installing, accessing, or using labreporter.in, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Use, Disclaimer, and Compliance provisions. If you do not agree, you must not install or use the software.
2. Intended Use
labreporter.in is intended solely for use by clinical and pathological laboratories operated by qualified pathologists, registered medical practitioners, or trained laboratory personnel and must be used strictly in accordance with applicable laws and professional standards in force in India.
3. Nature and Scope of the Software
labreporter.in is a software tool for laboratory data management and report generation only. It does not perform medical tests, does not interpret or validate laboratory results, and does not provide medical advice, diagnosis, prognosis, or treatment recommendations. The software does not qualify as a medical device or diagnostic system.
4. Medical Council / National Medical Commission Disclaimer
labreporter.in is not a medical practitioner, healthcare provider, or diagnostic authority and does not fall under the regulatory control of the National Medical Commission or any State Medical Council. All professional, ethical, statutory, and regulatory responsibilities rest entirely with the registered pathologist or laboratory issuing the reports. KRISHNA SOFTWARES bears no responsibility for medical negligence, professional misconduct, ethical violations, or misuse of medical credentials.
5. NABL (ISO 15189) Disclaimer
Use of labreporter.in does not imply, assure, or guarantee NABL accreditation or compliance with ISO 15189 standards. The software is not NABL-certified and serves only as a documentation and reporting aid. KRISHNA SOFTWARES shall not be liable for audit findings, non-conformities, or loss or suspension of accreditation.
6. Compliance with Applicable Laws
The user agrees to comply with all applicable central, state, and local laws, rules, regulations, and guidelines governing clinical laboratories, medical practice, information technology, and data protection, including but not limited to those currently in force in India.
7. Information Technology Act, 2000
labreporter.in is a general-purpose information system and is not classified as Critical Information Infrastructure under the Information Technology Act, 2000. The user is responsible for ensuring compliance with applicable provisions of the IT Act, including Sections 43, 43A, and 72A. KRISHNA SOFTWARES shall not be liable for unauthorized access, data breaches, or penalties arising from user negligence, inadequate security practices, or third-party software or hardware failures.
8. Digital Personal Data Protection Act, 2023
Under the Digital Personal Data Protection Act, 2023, the laboratory or diagnostic centre using labreporter.in acts as the Data Fiduciary, and KRISHNA SOFTWARES acts only as a Data Processor, if applicable. KRISHNA SOFTWARES does not access, collect, store, or transmit personal data outside the user's system. The user is solely responsible for lawful consent, data retention, responding to data principal rights, and breach reporting obligations.
9. Medical Ethics and Professional Regulations
The user is solely responsible for compliance with medical ethics, professional conduct regulations, laboratory licensing requirements, and applicable guidelines issued by medical councils, accreditation bodies, and government authorities. KRISHNA SOFTWARES shall not be responsible for any violation of such professional or ethical obligations.
10. Data Ownership and Privacy
All data entered, stored, or generated using labreporter.in remains the exclusive property of the user. KRISHNA SOFTWARES does not claim any ownership rights and has no relationship with patients, doctors, hospitals, or third parties reflected in the data.
11. Cybersecurity and Access Control
The user is responsible for implementing appropriate technical and organizational measures, including strong passwords, access restrictions, antivirus protection, and physical security. Any unauthorized access or misuse resulting from inadequate security controls shall be the sole responsibility of the user.
12. Data Backup and Retention
The user is responsible for taking regular backups and storing such backups securely in compliance with applicable medical and legal requirements. KRISHNA SOFTWARES shall not be liable for data loss, corruption, or unavailability.
13. License Grant and Restrictions
The software license is non-transferable and non-resalable and is valid only for the licensed laboratory or diagnostic center. Unauthorized copying, distribution, or commercial use is strictly prohibited.
14. No Refund and No Return Policy
Once the software is sold, installed, or activated, it is non-returnable and non-refundable under all circumstances.
15. Dongle (Hardware Lock) Policy
labreporter.in uses a USB hardware dongle for copy protection. The user is responsible for its safekeeping. In case of damage, replacement will be provided upon surrender of the damaged dongle and payment of applicable charges. In case of loss, a new license must be purchased at prevailing market prices.
16. Hardware, Software, and Network Responsibility
The user is responsible for maintaining suitable hardware, licensed operating systems, antivirus software, database systems, power backup, and network infrastructure, including a minimum 1 Gbps LAN for network installations.
17. Software Updates and Modifications
KRISHNA SOFTWARES reserves the right to modify, enhance, or discontinue features or modules and to introduce changes necessary for technological or regulatory compliance. Continued use of the software constitutes acceptance of such changes.
18. Support and Maintenance
Free support is provided for one year from installation. Thereafter, support is available only under an Annual Maintenance Contract, payable in advance, and is provided remotely through telephone or internet connectivity.
19. Support Timings
Support services are available between 10:00 AM and 7:00 PM Indian Standard Time, with a response time of up to thirty-six working hours.
20. Prohibited and Illegal Use
Use of labreporter.in for illegal activities, including fabrication of reports or fraudulent medical practices, is strictly prohibited and may result in termination of support and legal action, with all liability resting on the user.
21. Force Majeure
KRISHNA SOFTWARES shall not be liable for delays or failures caused by events beyond reasonable control, including natural disasters, power or internet failures, or government actions.
22. Limitation of Liability
To the maximum extent permitted by law, the total liability of KRISHNA SOFTWARES shall not exceed the license fee paid. KRISHNA SOFTWARES shall not be liable for indirect, incidental, or consequential damages.
23. Jurisdiction
All disputes shall be subject exclusively to the jurisdiction of the courts of Surat, Gujarat, India.
24. Statutory Supremacy
If any provision of these terms conflicts with applicable law, the law shall prevail, and the remaining provisions shall continue in full force.
